Your Protections Against Surprise Bills

When you receive emergency care or are treated by an out-of-network provider at an in-network facility without your prior consent, you are protected from surprise billing and balance billing.

What the Law Protects

  • Emergency Services: You cannot be billed more than in-network cost-sharing for emergency care, even from out-of-network providers.
  • Non-Emergency Care at In-Network Facilities: You cannot be billed at out-of-network rates for services at an in-network facility without advance notice and consent.
  • Air Ambulance Services: Balance billing protections apply to air ambulance services from out-of-network providers.
  • No Retroactive Consent: Providers cannot ask you to give up your protections as a condition of receiving care.
